By accessing or using the website located at fostercityasphaltpaving.com (the "Site"), or by requesting, scheduling, or receiving services from Foster City Asphalt Paving ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or request services from us.
Foster City Asphalt Paving provides asphalt paving, sealcoating, crack sealing, parking lot striping, pothole repair, concrete flatwork, drainage solutions, and related services to residential and commercial customers in Foster City, CA and surrounding areas in San Mateo County and the San Francisco Peninsula.
Services are provided only to properties within our service area and are subject to crew availability and scheduling. We reserve the right to decline a project at our discretion.
All written estimates provided by Foster City Asphalt Paving are valid for 30 days from the date of issuance unless otherwise noted. Estimates are based on site conditions observed at the time of the visit. If site conditions change materially before work begins - such as the discovery of additional damage, drainage issues, or base failure - the Company reserves the right to revise the estimate accordingly.
Verbal estimates are not binding. All pricing must be confirmed in a written quote or signed contract before work begins. Material prices, including asphalt mix, are subject to change based on market conditions, and revised pricing will be communicated to you before work starts if an increase applies.
Free estimates are provided at no obligation. Requesting an estimate does not commit you or the Company to any work.
Once a job is scheduled and confirmed, we ask for at least 48 hours notice if you need to cancel or reschedule. Short-notice cancellations may result in a scheduling fee if a crew has already been dispatched or materials have been ordered specifically for your job.
The Company reserves the right to reschedule work due to weather conditions, equipment issues, or other circumstances outside our control. We will notify you as early as possible and will work with you to find an alternative date. No fee applies when we initiate a rescheduling.
Asphalt paving and sealcoating require dry weather and appropriate temperature conditions. We will not perform work in conditions that would compromise quality, and we will reschedule if those conditions are not met on the day of service.
Payment terms will be outlined in your written contract or invoice. For most residential jobs, a deposit may be required to reserve a scheduling slot, with the balance due upon completion of the work.
Accepted payment methods will be specified in your contract. Invoices not paid within the agreed timeframe may be subject to a late payment fee as described in your contract. The Company reserves the right to pursue collection of unpaid balances through appropriate legal channels.
We do not require large upfront cash payments before work begins. Be cautious of any contractor who demands full cash payment in advance.
You are responsible for ensuring the work area is accessible on the scheduled date. This includes removing vehicles, personal property, planters, and any other items from the project area before the crew arrives. Failure to clear the work area may result in rescheduling and, in some cases, a fee.
If your property is governed by a homeowner association (HOA), you are responsible for obtaining any required HOA approval before work begins. The Company is not responsible for HOA violations resulting from work performed at your request without proper approval.
You are also responsible for identifying and marking underground utilities before excavation work begins. The Company will call 811 (USA Dig Safe) as required by law, but you should confirm any private utilities not covered by the public service.
Foster City Asphalt Paving stands behind the quality of our work. Specific warranty terms - including duration and coverage - will be outlined in your written contract. In general, our warranty covers defects in workmanship under normal use conditions.
Warranty coverage does not extend to damage caused by factors outside our control, including but not limited to: ground settling or heaving due to soil conditions, tree root intrusion, flooding, improper use of the surface (such as heavy equipment not disclosed prior to the job), or failure to follow post-installation care instructions.

Except as expressly stated in a written contract with you, the Site and all content on it are provided "as is" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be available at all times or free from errors.
To the fullest extent permitted by applicable law, Foster City Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the services we provide. Our total liability to you for any claim arising from a specific project shall not exceed the amount paid by you for that project.
If a dispute arises between you and Foster City Asphalt Paving relating to services performed or these Terms and Conditions, we encourage you to contact us first at hi@fostercityasphaltpaving.com so we can try to resolve the matter directly. Most issues can be resolved quickly through a direct conversation.
If direct resolution is not possible, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal proceedings not resolved through arbitration shall be brought in the courts located in San Mateo County, California.
We reserve the right to update or change these Terms and Conditions at any time. When we do, we will post the revised terms on this page and update the effective date at the top. Your continued use of the Site or request for services after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
